Description: The COVID pandemic, the "great resignation", growth of the gig economy, supply shortages and the rising costs of employing workers have caused employers to seriously look at how to staff their businesses. Many have turned to considering employees as independent contractors, or people who work only for a set period of time or on a certain project and then move on. However, employers run up against federal and state labor laws that are very specific regarding who is a true independent contractor and who must be considered an employee. Making a mistake in classification can be very costly, particularly when penalties, unpaid but required overtime compensation, benefits, and taxes are imposed. Federal law and various state statutes and court cases control who can be considered an independent contractor.

Presenter: Randell Brett is a former Chair of the New Jersey State Bar Association Solo and Small Firm Section, a delegate to the General Counsel, and an active member of the New Jersey chapter of the National Employment Lawyers Association.
